Can I assume that the car was sorned or had no insurance when you bought it? Even if you had insured it, the MID might not have picked up on it in half a day.The garage that took it away owe you the money but you will not get anywhere with that. Complain to the insurance company and demand that they repay you the release fee plus reasonable expenses. The Police will only go on what their ANPR says and that said you were not insured. If I am not understanding the OP tell us exactly what both of your insurance certificates say about driving other cars!

You have provided proof that your were insured at that time and had you the certificate with you I'm sure they would have had a glance and let you go on your way, possibly ignoring the ANPR wotsit in light of update times etc.
That's some overzealous policing on those charges though... sounds like you got a bit of a tosser from the outset. IME your average officer doesn't appreciate being told they're wrong and more than enough times I have had threats for all sorts of actions when I have, regardless of attitude, been completely within the law. e.g. threatened with an ASBO for not consenting to searches without the proper documentation and justifiable suspicion springs to mind
If I were you I'd have another word... I get what Paul is saying about the MID but the police can and do ring insurers direct to check insurance in these instances. If the officer hasn't done this then they've been very lazy and not done everything they can to determine if you're legal or not.

Yes Donald one call could have cleared the whole matter up if insurance was in place or not. Over my not inconsiderable life
dealing with Police is an art form. I find that asking politely what more could I have done to make sure I was not breaking the law helps. Would you help me sort this out? is another one. That usually works with most as they can show their superior knowledge ask if their is anyone they can contact?
Never grovel it looks like you have something to hide.Never get rude or kick off at them that is the quickest way to get them looking round your car for defects such as dodgy tyres,broken bulbs and cracked glass and loud exhausts etc and you will find you will be reported for that as well. If you are legal and they insist on being arseholes get legal advice asap

The car was on trade insurance when i bought it and newkids insurance covered us for the trip back- and yes i can understand the reason why we were stopped as it would have flagged up on their ANPR but they say they spoke to the Insurance company but i dont think they did. My feeling is that we explained - they ignored - i would have thought a seven day ticket would have been a reasonable way of dealing with this especially as they stated they believed what we were saying but we were still in the wrong. And they checked the car over for defects - two hours by the side of the M6 in storm conditions was not a pleasant experience and both cars had flat batteries from having the hazards on so long. I think IN10 and IN12 were the charges and both newkid and i would have not been able to afford the increase in insurance premium for our ludes had we been found guilty.

Thanks for the offer buddy - only question i have is regarding my record. Prior to this i had a clean record . I asked them if the charges would be wiped - they said they wouldnt but there would be a note put on to say no further action taken. Surely its possible to wipe the record clean? I went to the station yesterday and was there for over an hour and half whilst they escalated their call to the insurance company to manager lever in order to get them to change it to being unisured - they also pressed the manager to disclose wording we had used when we requested confirmation ourselves - the manager at the insurance company refused to answer their query citing data protection act. This delay in releasing the car meant the pound was closed when we got there which im sure they were aware of. After all of this i still dont want to make a complaint but i do want my money back - police said to claim money back from Insurance company but how can i make a claim against them when i was not party to the phone call they made to the insurance co. The insurance company have done nothing wrong imo. I always ask my Dad for advice and he says to leave it and just take the hit financially speaking - but cost of retrieving the car all adds up to just under £300 plus half a days lost wages...
