get in touch with the insurance get your witness statements and tell them you will not accept 50/50. I had an accident 2 years ago when the snow was really bad the road was like glass. I was tiptoeing round a corner when a guy came head on at me (incidently he lived on the corner and was on the wrong side of the road because he parks right were he hit me head on) it was a blind corner and he told the insurance first i was speeding :roll: then it was my fault i hit him :roll: luckily i had witnesses in a car that was right behind him who saw him cut over to the wrong side of the road as he took the corner. they were still going to go 50/50 because of the conditions to the point they had sent him a cheque i kept phoning and telling them it wasnt my fault and i wasnt going to accept it. The insurance company eventually stopped the cheque and agreed with me and i won out.

Police won't attend unless there was injury or the accident was causing traffic problems etc.

Despite what people think, a police report can only describe the aftermath, not the incident, unless of course they witness it. They will take statements, each will blame each other so it probably won't have changed the outcome.

Your witnesses will help, but are generally not admissible as they are not independent, unless you are in Scotland.

Also, if you have comprehensive cover and decide to claim for your own damage and your insurers declare your vehicle a total loss (ie write off), you can't tell them you don't want it written off! That isn't how it works. You may be able to renegotiate with the loss adjuster/claims assessor if you can demonstrate you can get the parts etc, but it is generally unlikely. The only way would be to withdraw your claim for your own damage so it doesn't end up being registered, as long as the insurers agree to this.

Likely outcome will be 50/50 unfortunately, you can claim 50% of your damages/loss/injury from her and she can claim 50% of her losses from you. You both lose your ncb.

You may be lucky and find your insurers are happy to push for 100% liability, but bear in mind she is convinced it is your fault so an put out court split liability settlement will be the most likely outcome, if only to keep the legal costs of the claim to a minimum.

BTW, knock for knock rarely exists anymore, this was an agreement between insurers where each are responsible for their own costs and is a different thing entirely to split liability.

If she doesnt produce no witness's, i cant see how they can still only go 50/50 with it. Insurance is a joke sometimes. And i cant see why i buy my self a nice car, as others clearly dont give a flying drokk.

Don't take offence at this, but it will be one word against another. She will probably be sat at home cursing you to her husband as she will honestly believe that you drive into her.

Insurance isn't a joke, it has to come to a conclusion, or lawyers just get richer and premiums escalate to compensate. If she put her hands in the air and said "sorry, my fault", the insurance would be sorted in next to no time. You can't blame the insurers if they are presented with two different and conflicting versions of events.

As I daid, your witnesses may help, but they are not independent.

Good luck but I doubt you'll win. Had an accident a few years ago, saw a car coming around a very shallow bend in the middle of the road, I had moved onto the verge at this point even though the road was more than wide enough because I was a bit concerned :lol: didn't help, he went straight into and then proceeded to ring his insurers and say I was at fault.

No witnesses and he'd been driving as long as I'd been alive so I ha no hope tbh. I clearly remember him putting on glasses when he got out of the car as well but of course I was making this up too :roll:

Pretty much unless you have witnesses these days you're not gonna get anywhere.

I was dealing with a 50/50 case with a nasty third party injury and the third party had non-independent witnesses. Insurers were ready to close it off on that basis until a Scottish summons arrived. Third party lived in Scotland a pursued it through the Scottish courts. Ended up being settled our client 100% at fault and out of court to reduce costs. They weren't happy to say the least!

Might have two witnesses but they'll be seen as biased.

As you say, you were in London, I don't think 'coincidence' will cut it when they see the names and addresses of your witnesses are from the same area as you :lol:
