Caught with no MOT twice

My housemate has just come to me telling me that yesterday he was pulled over driving home because his MOT was out of date. He was given a caution and told that a fine would be in the post, then sent on his way with the instructions that he should get it booked in and not use the car until then.

Well he has booked it in for Monday (which was earliest the garage could see him as closed weekends), and he has to use car to get too and from work on sunday. He is a bit worried that he will be pulled again and car will get crushed or something.

Any of you folks know what would likely happen to him if he gets pulled again with no MOT whilst using it for the small journey? The car is in superb condition and will pass MOT with flying colours, he is just an idiot and forgot to get MOT redone.

He should follow the advice and not use it. You are only allowed to drive a car without MOT to a place of test

Nope nope and nope.

If he's been told not to use it, then don't. Regardless of apparent condition, it has no MOT so is therefore assumed to not be in roadworthy condition.

I won't even go into the possibilities of what would happen to him should he get into an accident!

His insurance wont be invalid if he is in an accident, so that isnt an issue. His main concern is would the car be taken from him/given a hefty fine..

My advice to him was to call in sick sunday, to save any hassle but he doesnt want to do that

I think you mean "it WILL be invalid"......especially if he is "at fault" and the cause is found to be a defect that would have flagged up on the MOT.

I'm trying to work out if this is a genuine question, or a troll trying to wind us up?

Quite frankly, this is the only answer you will hear from us. It is people with attitudes like "your mate's" that cause insurance premiums to go up, and generally increase the cost of motoring.

You may be incorrect Gayno. MOT only proves the car is roadworthy at the time of the certificate being issued. As a result most insurers only require that the car must be kept in a roadworthy condition.

Not to say it wont make things difficult for him if he drives into someone without an MOT on his car.

Having no MOT doesn't void insurance. I don't think he would get his car taken off him if he go caught again, but he would more than likely be summoned to court and slapped with points and a £1000 fine.

Well seems you guys can deal with this calmer than I can.

Stuff like this really winds me up. Especially since the OP lives in Bristol, so I assume his "mate" does also and my Mrs is currently living down there while doing a work placement, so I suppose this has hit a personal nerve with me as well.

If he is in an accident without an MoT, the insurance may still cover him, but he will be at fault because his car should not have been on the road (unless traveling to MoT, as mentioned beforehand). This will vary with insurer though, and any insurer will try to get out of paying if they can.

More to the point though, if its a short journey can you not give a mate a lift?
