yar they might have the software but it'll never be activated Is what I think will be the case. Like having a lift with numbers to the 6th floor but you know the building only has 4 floors. Those floor buttons wont ever be used and are just 'there'. VW have acted immorally and illegally, for no reason other than to reduce their cost in developing and manufacturing vehicles that actually meet the required limits, why should there be any restriction on claims? Can't have it both ways - if it's a capitalist world, it's a capitalist world.
I have asthma. Maybe I should claim that VW's actions have caused me health problems and I am therefore entitled to compensation...

(Since these compensation claims are civil rather than criminal, the courts will of course be appplying reasonable judgement based on past commercial assessments and precedents, so in this country such claims are actually unlikely to succeed or extract much cash btw, so I wouldn't get too worried Donald
