Yes, I had heard that these companies try it on and it won't stand up in a court of law. The worse bit is that I was nowhere near Birmingham on the day!Therealjj91 wrote:Is it the council? They are the only ones who can actually fine you, I've had literally hundreds of £'s in fines from private companies and I've never been taken to court and some of them had a picture of my car with my reg. They will keep sending you threatening letters with big red writing saying they will take you to court etc. and they will keep ringing your phone off an unknown number, just keep ignoring the letters and don't answer the phone calls and they will eventually leave you alone, trust me
Congratulations to vtecmec for winning May/June's Lude Of The Month, with his DIY Turbo BB1 build.

I had a similar experience with BCP. I just ignored them.Therealjj91 wrote:Is it the council? I did a thread about this recently, where Lisa's car got slapped with a parking fine from a private company (can't find the post now though
).
As mec says, they need to prove loss of earnings under civil losses.
Unless it was a clearly designated chargeable area to park, they have no loss of earnings anyway (mine was in a permit residents parking permit area, but where the residents permits were free issue, so there was no chance of them being able to demonstrate any loss of earnings through my actions taking up a permit space!)
They did eventually give up and stop sending threatening letters after 6 months.
I recommend that approach rather than sending anything back to them - that way they keep merrily forking out cost in in printing and postage for no outcome
